User Rights
Right of Withdrawal
Unless specific exceptions apply, Users may be eligible to withdraw from the contract within a defined period, typically 14 days, for any reason and without justification. Users can find further details about withdrawal conditions in this section.
Who the Right of Withdrawal Applies To
Unless otherwise specified in applicable exceptions, European Consumers have a statutory right to withdraw from online contracts within a specified period, allowing for withdrawal without justification.
Exercising the Right of Withdrawal
To exercise this right, Users must communicate their intention to withdraw from the contract to the Owner unequivocally. Users can use the provided model withdrawal form in the "definitions" section of this document, or express their intention in another suitable manner. Users must ensure they submit the withdrawal notice before the withdrawal period expires.
When Does the Withdrawal Period Expire?
For goods, the withdrawal period typically ends 14 days after the User or a third party (other than the carrier, designated by the User) takes physical possession of the goods. In cases of multiple goods delivered separately or a single good consisting of multiple lots or pieces delivered separately, the withdrawal period expires 14 days after the User or a third party (other than the carrier, designated by the User) acquires physical possession of the last item.
Effects of Withdrawal
Users who withdraw from a contract as prescribed will be reimbursed by the Owner for all payments made, excluding delivery costs, if applicable. Reimbursements will be made without undue delay, no later than 14 days from the Owner's notification of the User's decision to withdraw. Reimbursements will be processed using the same payment method as the initial transaction. Users will not incur any costs or fees due to the reimbursement.
On the Purchase of Physical Goods
If the Owner has not offered to collect the goods, Users must return or hand them over to the Owner or an authorized representative without undue delay, and in any case, within 14 days of communicating their decision to withdraw from the contract. Users are responsible for the cost of returning the goods. The Owner may withhold reimbursement until the goods are received or until Users provide evidence of returning the goods, whichever comes first. Users are liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functionality.
Exceptions from the Right of Withdrawal
The right of withdrawal does not apply to contracts:
- Involving sealed goods not suitable for return due to health protection or hygiene reasons and unsealed after delivery.
Legal Guarantee of Conformity for Goods
Under EU law, for at least 2 years after delivery, traders guarantee the conformity of goods they sell. This means that traders must ensure the goods purchased possess the promised quality or qualities that can be reasonably expected, functionality, or characteristics for a minimum of two years after delivery to the purchaser. European Consumers benefit from the legal guarantee of conformity for goods in accordance with their country's laws, which may grant broader rights.
Common Provisions
- No Waiver: The Owner's failure to assert any right or provision under these Terms shall not constitute a waiver of any such right or provision. No waiver shall be considered a further or continuing waiver of such term or any other term.
- Service Interruption: To ensure the best possible service level, the Owner reserves the right to interrupt the Service for maintenance, system updates, or any other changes, informing Users appropriately. Within the limits of the law, the Owner may also decide to suspend or terminate the Service altogether. If the Service is terminated, the Owner will cooperate with Users to enable them
